BulkMess Terms of Service

Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User" or "you") and Daniil Mukashev ("we," "us," or "our") regarding your use of the BulkMess mobile application ("App" or "Service").

By accessing or using BulkMess, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

What BulkMess Does

BulkMess is an iOS application that helps users manage and send SMS campaigns through integration with iOS Messages. The app provides:

• Contact management and organization
• Message template creation and customization
• Bulk SMS campaign management
• Campaign analytics and reporting
• iOS Shortcuts integration
• Automated messaging features (premium)

Permitted Uses

You may use BulkMess for legitimate business and personal communication purposes, including:

• Business communications and marketing
• Event coordination and notifications
• Personal messaging to contacts
• Customer service communications
• Educational or non-profit communications

Prohibited Uses

You agree NOT to use BulkMess for:

• ❌ Sending spam, unsolicited, or bulk commercial messages
• ❌ Harassment, threats, or abusive communications
• ❌ Fraudulent, deceptive, or misleading messages
• ❌ Violating applicable laws or regulations
• ❌ Circumventing carrier limitations or restrictions
• ❌ Sending messages to contacts without proper consent
• ❌ Illegal activities or promoting illegal content
• ❌ Violating third-party rights or privacy

Subscription Plans

BulkMess offers the following subscription options:

• Weekly Plan: $9.99/week with 3-day free trial
• Yearly Plan: $36.99/year (69% savings)

Free Trial

New users may be eligible for a free trial period. Free trials:

• Are limited to first-time subscribers
• Automatically convert to paid subscriptions unless cancelled
• Can be cancelled anytime during the trial period
• Provide access to premium features during the trial

Billing and Renewal

• Subscriptions are billed through your Apple ID account
• Payment is charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the current period ends
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel your subscription by going to your account settings on the App Store after purchase

Cancellation

You may cancel your subscription at any time by:

1. Going to iOS Settings > [Your Name] > Subscriptions
2. Selecting BulkMess from your active subscriptions
3. Choosing "Cancel Subscription"

Cancellations take effect at the end of the current billing period.

Message Delivery

BulkMess relies on iOS Messages and your cellular carrier for message delivery. We cannot guarantee:

• Successful delivery of all messages
• Delivery timing or speed
• Carrier compliance or restrictions
• Network availability or reliability

Carrier Charges

Standard messaging rates from your wireless carrier may apply. You are responsible for any carrier charges incurred through use of the app.

Usage Limitations

You acknowledge that excessive messaging may result in:

• Carrier blocking or filtering
• Reduced delivery rates
• Account suspension by your carrier
• Legal consequences for spam or violations

Data Storage

BulkMess stores all your data locally on your device. We do not upload your contacts, messages, or campaign data to our servers.

Privacy Protection

Your privacy is important to us. Please review our Privacy Policy to understand how we handle your information.

User Responsibility

You are responsible for:

• Obtaining proper consent before messaging contacts
• Complying with applicable privacy laws
• Protecting your device and data
• Backing up important information

Facebook Analytics Integration

BulkMess uses the Facebook SDK for analytics and advertising purposes. By using BulkMess, you also agree to:

Data Collection and Usage

The Facebook SDK may collect and process:

• App usage events (opens, purchases, campaign creation)
• Device information (model, iOS version, IP address)
• Advertising identifier (only if you grant tracking permission via iOS settings)
• Aggregate analytics data for ad performance measurement

Important: We do NOT share your contacts, message content, or recipient information with Facebook or any third parties.

App Tracking Transparency

On iOS 14.5 and later, you have control over tracking:

• You'll be asked for permission to track your activity across apps and websites
• You can grant or deny this permission
• You can change your decision anytime in iOS Settings → Privacy & Security → Tracking
• If you deny tracking, we use Apple's SKAdNetwork for privacy-preserving ad measurement

Third-Party Service Changes

Third-party services (like Facebook SDK) may update their terms independently. We are not responsible for changes to third-party terms or policies, but we'll notify you of material changes that affect your use of BulkMess.

Service Availability

BulkMess is provided "as is" without warranties of any kind. We do not guarantee:

• Continuous, uninterrupted service availability
• Error-free or bug-free operation
• Compatibility with all devices or iOS versions
• Protection against data loss

Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for:

• Direct, indirect, incidental, or consequential damages
• Loss of profits, data, or business opportunities
• Damages resulting from message delivery failures
• Legal consequences of your message content or usage
• Third-party actions or carrier restrictions

Terms Updates

We may modify these Terms at any time. When we make changes:

1. We'll update the "Last Updated" date
2. Significant changes will be announced in the app
3. Continued use constitutes acceptance of new terms
4. You'll be notified of material changes affecting your rights

App Updates

We may release updates to improve functionality, fix bugs, or add features. Some updates may be required for continued service access.

Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction where the developer is located, without regard to conflict of law principles.

Compliance

You agree to comply with all applicable laws and regulations, including:

• CAN-SPAM Act (United States)
• GDPR (European Union)
• TCPA (Telephone Consumer Protection Act)
• Local messaging and privacy laws

Dispute Resolution

Any disputes arising from these Terms or your use of BulkMess will be resolved through binding arbitration, except where prohibited by law.

Termination by You

You may stop using BulkMess at any time by:

• Deleting the app from your device
• Cancelling your subscription (if applicable)
• Discontinuing use of the service

Termination by Us

We may suspend or terminate your access to BulkMess if you:

• Violate these Terms of Service
• Use the app for prohibited purposes
• Engage in fraudulent activity
• Harm the service or other users

Effect of Termination

Upon termination:

• Your access to premium features will cease
• Local data remains on your device
• Subscription charges will continue until cancelled
• These Terms remain in effect for resolved matters
