Acceptance of Terms

Welcome to Time Tracker. By downloading, installing, or using our iOS application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you ("User" or "you") and Time Tracker ("we," "us," or "our").

Eligibility

You must be at least 13 years old to use this App. If you are between 13 and 18 years old, you must have your parent or legal guardian's permission to use the App and agree to these Terms.

By using the App, you represent and warrant that you meet these eligibility requirements.

License to Use

Grant of License

We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on iOS devices that you own or control, strictly in accordance with these Terms and the Apple App Store Terms of Service.

Restrictions

You may not:

• Copy, modify, or distribute the App or its content
• Reverse engineer, decompile, or disassemble the App
• Remove any copyright, trademark, or proprietary notices
• Use the App for any unlawful purpose
• Transfer, sell, or sublicense your rights to use the App
• Attempt to gain unauthorized access to the App or its systems
• Use the App in any way that could damage or impair our services

Subscriptions and Payments

Subscription Plans

Time Tracker offers the following subscription options:

• Weekly Premium: $4.99 USD per week (includes 3-day free trial)
• Yearly Premium: $29.99 USD per year (no free trial)

Prices may vary by region and are subject to change. All prices include applicable taxes.

Free Trial

New subscribers to the Weekly Premium plan are eligible for a 3-day free trial. During the trial period:

• You have full access to all premium features
• You can cancel anytime before the trial ends to avoid being charged
• If you don't cancel, your subscription will automatically begin after the trial ends
• You will be charged the subscription price at the end of the trial

Important: Only one free trial per user. Free trials are not available for users who have previously subscribed.

Auto-Renewal

Payment Processing

All payments are processed through Apple's App Store. We do not have access to your payment information. Your subscription is subject to Apple's Terms of Service and Privacy Policy.

Managing Your Subscription

You can manage and cancel your subscription at any time:

1. Open the Settings app on your iOS device
2. Tap your name at the top
3. Tap "Subscriptions"
4. Select "Time Tracker"
5. Tap "Cancel Subscription" to turn off auto-renewal

Cancellation Policy

You may cancel your subscription at any time. Upon cancellation:

• You retain access to premium features until the end of your current billing period
• You will not be charged for the next billing period
• No refunds are provided for partial billing periods
• Your data remains accessible in the app (stored locally on your device)

Refund Policy

All sales are final. Refund requests must be submitted directly to Apple through the App Store:

• Visit reportaproblem.apple.com
• Sign in with your Apple ID
• Find your Time Tracker purchase
• Select "Request a Refund" and choose a reason

Refund decisions are made solely by Apple according to their policies. We have no control over refund approvals.

Price Changes

We reserve the right to change subscription prices at any time. If we increase the price:

• Existing subscribers will be notified at least 30 days in advance
• The new price will take effect at your next renewal
• You can cancel before the price change takes effect

User Responsibilities

Your Account

Your Time Tracker subscription is tied to your Apple ID. You are responsible for:

• Maintaining the security of your Apple ID
• All activity that occurs under your account
• Ensuring your payment information is current

Data Backup

You are solely responsible for backing up your data. Time Tracker stores all data locally on your device. We recommend:

• Regularly using iOS device backups (iCloud or iTunes)
• Exporting your data periodically using the app's export feature

We cannot recover lost data if you delete the app, lose your device, or experience device failure.

Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You will not:

• Use the App in any way that violates applicable laws or regulations
• Share your subscription access with others
• Attempt to circumvent subscription requirements
• Use automated systems to interact with the App

Intellectual Property

Our Rights

Time Tracker and all its contents, features, and functionality are owned by us and are protected by copyright, trademark, and other intellectual property laws. This includes:

• App design, interface, and user experience
• Source code and software
• Logos, branding, and trademarks
• Documentation and help materials

Your Data

You retain all rights to the data you create in the App (time entries, project names, notes, etc.). Since all data is stored locally on your device, you maintain full ownership and control.

App Availability and Changes

Service Availability

We strive to keep the App available and functional at all times. However, we do not guarantee:

• Uninterrupted or error-free operation
• That defects will be corrected
• That the App is free from viruses or other harmful components
• Compatibility with all devices or iOS versions

Updates and Modifications

We reserve the right to:

• Update, modify, or discontinue the App at any time
• Add or remove features
• Change the App's functionality
• Require app updates to continue using the service

We will make reasonable efforts to notify users of significant changes.

Termination

We may terminate or suspend your access to the App immediately, without prior notice, if:

• You violate these Terms
• You engage in fraudulent or illegal activity
• Your payment fails or is reversed
• You abuse or misuse the App

Disclaimers

No Professional Advice

Time Tracker is a productivity tool only. It does not provide professional, financial, legal, or business advice. Any decisions you make based on data from the App are your sole responsibility.

Limitation of Liability

Indemnification

You agree to indemnify, defend, and hold harmless Time Tracker and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Any data you input into the App

Dispute Resolution

Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions.

Informal Resolution

If you have a dispute with us, please contact us first at support@timetracker.app to attempt to resolve it informally.

Arbitration Agreement

Any dispute arising out of or relating to these Terms or the App that cannot be resolved informally shall be resolved through binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.

Class Action Waiver

You agree that any arbitration or court proceeding shall be limited to the dispute between you and us individually. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Third-Party Services

Apple App Store

The App is distributed through the Apple App Store and is subject to Apple's Terms of Service. You acknowledge that:

• These Terms are between you and us, not Apple
• Apple is not responsible for the App or its content
• Apple has no obligation to provide support for the App
• Apple is a third-party beneficiary of these Terms and may enforce them

Export Functionality

The App may allow you to export data to third-party services (email, cloud storage, etc.). Your use of those services is governed by their respective terms and privacy policies, not ours.

Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we handle your information. By using the App, you agree to our Privacy Policy.

Children's Privacy

The App is not intended for children under 13. We do not knowingly collect personal information from children under 13. If you believe a child has provided us with personal information, please contact us.

Changes to These Terms

We may update these Terms from time to time. When we make changes:

• We will update the "Last Updated" date at the top
• We will notify you through the App or via email
• Material changes will be effective 30 days after notification
• Your continued use after changes take effect constitutes acceptance

We encourage you to review these Terms periodically.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App and supersede any prior agreements.

No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign our rights and obligations without restriction.

Acknowledgment

By using Time Tracker, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
